MDHHS Keeps Small Bars Open, Sets 50 Percent Occupancy Limit for Bars/Restaurants

Only three COVID-19 outbreaks (defined as two or more cases linked to one place) were tied to bars in the most recent data gathered by MDHHS, which accounted for a two-week period ending October 1.
BREAKING: 70/30 Gone, Bars Can Reopen with Limited Restrictions

Today, MDHHS issued an Emergency Order under MCL 333.2253, which allows bars to reopen statewide, with limited restrictions. The 70/30 distinction is no longer! This order is effective immediately and remains in effect until October 30, 2020.

Whitmer Opens Bowling Alleys with Restrictions

Governor Whitmer today signed Executive Order 2020-176, which allows for the reopening of bowling alleys throughout the state for leagues and other organized events. There was no change to bowling alleys in regions 6 & 8, which can remain open for public play as long as they abide by social distancing measures and an occupancy restriction of 25% or 250, whichever is smaller.

There has been a lot of false reporting that all bars must shut down on July 31. This is not true. Bars whose gross receipts total 30% or more from non-alcohol sales can remain open for indoor and outdoor service. Bars whose gross receipts total less than 30% from non-alcohol sales can remain open for outdoor service. PLEASE READ ABOUT THE 70/30 DISTINCTION BELOW.

Governor Whitmer today signed an executive order requiring all businesses open to the public to require face masks and to turn away individuals not wearing a mask. Individuals who violate the order are subject to a misdemeanor and $500 fine.

In response to the economic impact of COVID-19, the State of Michigan has allocated $100 million of CARES Act funding to implement the Michigan Small Business Restart Program to support the needs of Michigan Businesses directly impacted by COVID-19. The Michigan Senate today passed Senate Bill 942 (S-2), which was sponsored by Aric Nesbitt. The bill contains a number of items that would greatly impact on-premises licensees now and moving forward. The MLBA is happy to announce that Governor Whitmer has moved the entire state into Phase 4 of her MI Safe Start plan. Beginning next week at 12:01 a.m., on June 8, bars and restaurants statewide will be allowed to open for in-house service (including alcohol service) with some stipulations. The governor also lifted her stay-at-home order.
